Introduction

Hybrid Calisthenics LLC (together with our affiliates, “Hybrid Calisthenics”, “we”, or “us”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.  This Privacy Policy is meant to help you understand how we collect, use and share information to operate, improve, develop and help protect our services, or as otherwise outlined in the Privacy Policy.

This Privacy Policy applies only to information we collect in this Hybrid Calisthenics applications (the "App"), or when you interact with us via our call centers, support services, and in other electronic communications sent through or in connection with the App(together, the "Services"). This Privacy Policy applies to our Services except where otherwise noted.

This Privacy Policy does not apply to information that (i) we collect offline or on any other Hybrid Calisthenics websites, including websites you may access through this App, or (ii) you provide to or is collected by any third party.  Our websites and other apps, and these other third parties, may have their own privacy policies, which we encourage you to read before providing information on or through them.

Unless otherwise defined in this Privacy Policy, capitalized terms have the meaning specified in our Terms of Use. 

Please be sure to read this entire Privacy Policy before using or submitting information through the Services.  By using or submitting information through the Services, you are acknowledging the collection, transfer, manipulation, processing, storage, disclosure and other uses of your personal data as described in this Privacy Policy.  If you do not agree with our policies and practices, do not download, register with, or use this App.  This policy may change from time to time.  Your continued use of this App after we revise this policy means you accept those changes, so please check the policy periodically for updates.

1. WHAT PERSONAL INFORMATION WE COLLECT

Depending on how you interact with Hybrid Calisthenics and our Services, we may collect your personal information. The sources from which we collect this personal information fall into two categories: information you provide, and information we collect automatically, Information we collect from other sources. See below for more information on the types of personal information in each category.

1.1. Information you provide

When you interact with this App, you may volunteer personal information, or you may be asked to provide personal information in order for us to provide the Services as described. Examples of interacting with Us: accessing our Services, completing and/or using one of our registration forms, reviewing our Content, or contacting us with inquiries.

Standard Identifying Information. When you download, register with, or use this App, we may ask you provide your name, mailing address (including zip code),  and email, .  As part of your user profile, you will also be required to provide us with a username and a password for your Account.  These are collected when you register for our Services. 

Subscription Information. Details related to any of your Subscriptions that you purchase. Please note, we do not store or capture any credit card or payment method information, and your Subscription purchases will be done through the App Providers. This information is collected directly by the App Providers and their payment processing agents, but we would like to inform you about its collection since this information is collected from you in connection with our App and from you, as our Subscription Holder.

Physical Characteristics and Workout Goals and Preferences. 

Physical and personal characteristics.  Information you chose to provide in order to enable us to provide you with personalized user experience and recommendations, including age, gender, height, and weight.

Workout preferences, activity levels, and fitness goals.  In order to obtain personalized user experience and recommendations, you may chose to provide us with responses concerning your workout preferences, activity levels, and your overall fitness goals.  In each instance, you will select your responses in these categories from a set of pre-defined options, as listed in the App.  We do not collect health or medical information, however, some privacy-related legislation may classify some of this information as health-related information.

Workout details.  As part of the personalized user experience that may be available to you in the App as part of your Subscription, you may chose to self-report certain details concerning your workouts, including for example, the numbers of sets (or repetitions in each set) performed for a particular workout or exercise, date of such exercises, and numbers of days of continuous workout activity.   We do not collect health or medical information, however, some privacy-related legislation may classify some of this information as health-related information.

Feedback and Support Communications. Any details of your communications/interactions with us, including when you communicate with our support teams or communicate with our trainers.  We may record support calls for training and monitoring purposes and to help resolve issues.  We will tell you before recording and, where required by applicable laws, obtain your consent for the collection of these recordings.  Among the support features available in the App, we offer a messenger support tool to give customers a choice of self-serve or live support, where possible.  Our live chat Service Provider records information submitted in the chat bot, as well as any dialogue with member support, and your first and last name and email may be used to create a contact record with our live chat Service Provider.  In addition, your contact record with our live chat Service Provider may collect your device information, including the operating system type and version number, manufacturer and model, browser type and language, and screen resolution, and IP address.  We collect, retain, and use communication information to provide our Services to you and to receive and act upon your feedback or issues, and for training purposes.

Other Information. Any other information that you may provide to us in connection with your use of this App or other contact that you have with the Hybrid Calisthenics team in connection with or through the App.

1.2. Information that we collect automatically

Information from your device. 

Device Data: Information from and about the device you use when you use our Services, including device type, IP address,  mobile carrier, browser type and language, and operating system.

Usage Data: We may also collect information about how your device interacts with our Services, such as the content you access, the date and time of your use, the amount of time spent on the Services, and other actions taken through use of the Services such as preferences. We use data analytics with this usage data to better understand your use of the Services in order to improve the Services offered.

2. WHY WE USE PERSONAL INFORMATION

We use your information for the following purposes:

To provide you with the Services. Hybrid Calisthenics uses data to operate, improve, maintain and personalize our Services. We use data to:

  • Verify your identity, set up and maintain your Account;

  • Maintain our services and operations.

To communicate with you. Supporting and communicating with you when you require it such as for either the administrative matters (such as account management, updates to terms, or system maintenance), or to provide you with our Services or information about our Services.

To send you marketing and/or promotions. Hybrid Calisthenics uses data to market its Services, which may include contacting you by email, postal mail, push notifications, or in-app messages with information about news, offers, products, promotions, events, contests and/or Services that might be of interest to you, as permitted by applicable law. This may include various usage data to send marketing communications that are personalized. Please see the “Your Privacy Rights and Preferences” section below for how to unsubscribe from marketing.

For quality assurance and training purposes. Hybrid Calisthenics puts users first and we use data to further that value by monitoring communications and interactions with you to ensure the quality of our support services, appropriate training of our people and to resolve your complaints. We will provide notice and consent options for monitoring of communications as required by applicable law.

For personalization and analytics.

  • To provide workout recommendations to you based on  your preferences and practices;

  • To improve our services and product offerings;

  • To understand how you interact with our App, and communications with you;

  • To determine which of our products or services are the most popular; to improve our products and services, and marketing campaigns;

  • To personalize your experience; to understand how you use our Services; to create a more personalized experience; to provide services;

To ensure the security and integrity of our Services. Providing a safe and secure environment is key to providing a responsible platform and we do this by using data to detect and combat any abuse or any harmful activity, fraud, spam, and illegal activity affecting our Services such as using personal identifiers, user profile, data usage, and other types of data to detect fraud, authentication or other harmful activity

To comply with any applicable law and/or regulations, legal proceedings. We use data to investigate disputes or claims related to our Services. In certain circumstances, we may be obligated to use your information to respond to legal, government or regulatory requests. We may use the IP address associated with your log in to the Services to determine your general location in order to comply with global privacy regulations and serve you necessary notifications and/or consent mechanisms.

For safeguarding and defending our vital interests and exercising any rights, asserting any claims and any other lawful business purpose. This includes any incidental business purpose related to or in connection with any of the above, or for any other purpose disclosed to you at the point at which we collect your personal information.

3. WHO WE SHARE YOUR PERSONAL INFORMATION WITH

We may disclose your personal information to the following categories of recipients:

Service Providers. We may share your personal information with our third party service providers (such as those who provide IT, analytics, communication tools, cloud storage providers, or technical support), or third party business partners, who in each instance otherwise process personal information for purposes that are described in this Privacy Policy.  We may also disclose aggregated, anonymous information to service providers.  This information is not linked to personal information that can identify you or another individual person. Amongst other reasons, this information may be disclosed for analytics purposes.

Competent Law Enforcement Bodies, Regulators, Government Agencies, Courts or other Third Parties. We may share your personal information, with competent law enforcement bodies, regulators, our insurers, external legal advisors, government agencies, courts or other third parties where we believe disclosure is necessary: (i) to comply with applicable law; (ii) to exercise, establish or defend our legal rights (including to collect amounts owed to Hybrid Calisthenics); (iii) to protect your rights or vital interests or those or any other person; or (iv) to detect, prevent or otherwise address security, fraud or technical issues.

Potential Buyers (and their agents and advisors). We may share your personal information with actual or potential buyers (and their agents and advisors) in connection with any actual or proposed purchase, merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of company assets or transition of service to another provider, provided that we inform the buyer or transferee that it must use your personal information only for the purposes disclosed in this Privacy Policy.

4. INTERNATIONAL DATA TRANSFERS

Please note that the App is presently available for use within the jurisdiction of United States only, and this limitation includes all Accounts.  Any user outside the jurisdiction of United States accessing this App is entirely undertaking the responsibility and risk of using these Services, and Hybrid Calisthenics will not be responsible for any loss, damage, or any occurrence arising out of such communication or transaction occurred outside this permitted jurisdiction.

In order to protect your personal information when it is transferred to the United States, we have taken appropriate safeguards to ensure that your personal information will remain protected in accordance with this Privacy Policy. By registering with or continuing to use the App, you understand that your information will be transferred to the United States and to those third parties with whom we share it as described in this Privacy Policy.

5. YOUR PRIVACY RIGHTS AND PREFERENCES

At Hybrid Calisthenics, we put users first and respect your ability to exercise your privacy rights and choices. Where possible, we give you control over the personal data we collect about you, to ensure it is accurate and reflects your preferences.

You can review and change your personal information by logging into the App and visiting your Account profile page.  Through your Account, you are also able to recover or reset your password.

You may also delete your Account at any time.  Please note that if you delete your Account, this will result in the deletion of your Hybrid Calisthenics Account and all associated information.

5.1 Analytics

We use Google Analytics to collect information for analytics purposes, as described in the “Information from your device” section of this Privacy Policy.   For more information about Google Analytics, please visit www.google.com/policies/privacy/partners/.  You can opt-out of Google’s collection and processing of data generated by your use of the Services by going to https://tools.google.com/dlpage/gaoptout. 

5.2 Direct Marketing

We may send marketing communications for purposes disclosed to you (including as specified in section 2 above) and, where required by applicable law, with your consent. You can unsubscribe from direct marketing at any time by following the instructions below. We will process your request within a reasonable time after receipt, in accordance with applicable laws. Unsubscribe options are provided in electronic marketing communications as required by applicable law.

Email. You can unsubscribe from email communications at any time. To stop receiving our promotional emails, follow the unsubscribe instructions in the email messages you receive from us  We will process your request as soon as practicable after receipt, in accordance with applicable laws. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding Hybrid Calisthenics and our Services and, to the extent permitted by law, you will not be able to opt-out of those communications (e.g., communications regarding updates to our Terms or this Privacy Policy).

Push Notifications. If you opt-in on your device, Hybrid Calisthenics may occasionally send you push notifications through our App with updates, achievements, reminders, and other notices that may be of interest to you. You may at any time opt-out from receiving these types of communications by changing the settings on your device.

5.3 Third-Party Information Collection

When you use the App or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. 

These third parties may use tracking technologies to collect information about you when you use this App. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

This App uses the online marketing tool AdMob by Google.  AdMob is a mobile advertising platform that uses certain tracking technologies to serve ads that are relevant to users.  Through the integration of AdMob with our App, Admob uses some of the information collected by our App, including your mobile device brand, model, or category.  We have no influence on the scope and further use of the data collected by Google in this regard, but provide you with this disclosure and notice based on our best understanding of the AdMob services, and the related collection and usage of your information.  You can at any time choose the option to refuse further access to your data by directly following the instructions of the third-party advertisers and/or advertising networks.  To do so in connection with AdMob by Google, please visit the following link.  For more information on Google AdMob, please visit https://admob.google.com/home/resources/what-is-admob/. 

 

6. DATA RETENTION

Hybrid Calisthenics retains the personal information we receive as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements and comply with applicable laws. When we are no longer required to retain the personal information as described above, we will destroy, erase, or de-identify it. 

Legal requirements, however, may require us to retain some or all of the personal information we hold for a period of time that is longer than that for which we might otherwise hold it.

7. SECURITY OF YOUR INFORMATION

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. We maintain commercially reasonable administrative, technical and physical safeguards (which vary depending on the sensitivity of the personal information) designed to protect against unauthorized use, disclosure or access of personal information.   However, the security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.  Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

The safety and security of your information also depends on you, and you are responsible for keeping your Account access confidential secure.  We ask you not to share your Account username and password with anyone.

8. CHILDREN’S PRIVACY

Our App is not intended for use by children under the age of 13.  No one under the age of 13 may provide any personal information on the App.  If you are under 13, do not use or provide any information on this App or through any of its features, register on the App, or provide any information about yourself to us.  We do not knowingly collect personal information from individuals under 13 years of age.  If you believe we may have collected information from a child under 13, please contact us, and we will promptly delete the information.

We will obtain your consent to any material Privacy Policy changes if and where this is required by applicable data protection laws.  You can see when this Privacy Policy was last updated by checking the "last updated" date displayed at the top of this notice.
